The Trump administration's 10 percent
global tariff, imposed in February after the Supreme Court struck down its predecessor, expires at 12:01 a.m. Friday. The White House has a replacement ready. In June the administration proposed tariffs on 59 countries and the European Union under Section 301 of the Trade Act of 1974, citing those nations' failure to prohibit goods made with forced labor. The new duties, set at 10 to 12.5 percent, would cover countries supplying more than 99 percent of U.S. imports — effectively replicating the expiring levy through a different legal
vehicle.

More tariffs are in the pipeline. The administration has also proposed a separate Section 301 package targeting 15 countries and the EU for what the White House calls unfair manufacturing practices. And this week Trump signed orders imposing a 50 percent tariff on billions of dollars of Canadian exports under the Tariff Act of 1930, better known as the Smoot-Hawley Tariff Act.

For businesses, the practical reality is that elevated import costs appear permanent regardless of
which legal authority is invoked. The administration's willingness to cycle through trade statutes signals that importers should plan for sustained tariff pressure rather than waiting for a court ruling to restore the pre-tariff status quo.
